1Acceptance of terms

By creating an account, browsing the Kunch platform, or using any of our services, you agree to be bound by these Terms of Service. If you do not agree, do not use Kunch.

These terms apply to all users — customers, bakers, and visitors. Where specific terms apply to bakers only or customers only, this is stated explicitly.

2What Kunch is

Kunch Technologies Pvt. Ltd. ("Kunch", "we", "us") operates an online marketplace that allows registered bakers to list handcrafted food products and allows customers to discover and contact those bakers directly.

• Kunch is a discovery and connection platform.
• Kunch provides a searchable, location-sorted directory of local bakers and their products.
• Kunch allows customers to view baker contact details and reach out independently.
• Kunch allows customers to leave ratings and reviews for products they have ordered.
• Kunch provides bakers with a public storefront at zero cost and zero commission.

3What Kunch is not

• No delivery. Kunch does not pick up, transport, pack, or deliver any food product. All logistics are arranged directly between buyer and baker.
• No order management. Kunch has no order system, no basket, and no checkout. We do not track order status.
• No payment processing. Kunch does not handle, hold, transfer, or refund any money. Payments happen entirely outside our platform.
• No quality guarantee. Kunch does not taste, inspect, certify, or guarantee the quality, safety, freshness, or hygiene of any listed product.
• No food safety liability. Kunch is not responsible for foodborne illness, allergic reactions, or any harm arising from consuming products found on our platform.

4Customer terms

As a customer using Kunch, you agree to:

• Provide accurate information during account creation.
• Use the contact information of bakers only for legitimate order enquiries — not for spam, harassment, or unsolicited marketing.
• Post honest and accurate reviews based on genuine experiences. You may only review a product you have actually ordered.
• Not attempt to manipulate the review or ratings system.
• Verify allergen, dietary, and ingredient information directly with the baker before placing any order. Kunch cannot guarantee the accuracy of information listed by bakers.
• Exercise your own judgement when transacting with bakers. Kunch does not vet every baker or verify every claim on their listings.

5Baker terms

As a baker listing on Kunch, you agree to:

• Provide accurate information about your bakery, products, and contact details.
• List only food products you actually produce yourself or have legal authority to sell.
• Price your products honestly — the listed price must be the actual price customers pay.
• Update your listings promptly when a product is unavailable, discontinued, or changed.
• Comply with all applicable food safety laws in India, including the Food Safety and Standards Act 2006 and FSSAI regulations.
• If you claim an FSSAI licence number, ensure it is your valid, current licence. Providing a false or expired licence number is a violation of these terms and may be illegal.
• Not post fake reviews for your own listings or arrange for others to do so.
• Handle all orders, payments, and deliveries personally. Kunch bears no responsibility for transactions between you and your customers.
• Not use Kunch to sell non-food items, controlled substances, or any item prohibited by law.

6Prohibited conduct

The following are strictly prohibited on Kunch. Violations may result in immediate account suspension:

• Creating multiple accounts to circumvent bans or review limits.
• Impersonating any person, business, or government body.
• Uploading content that is defamatory, obscene, or unlawful.
• Attempting to access, scrape, or reverse-engineer Kunch's systems, database, or API without authorisation.
• Using Kunch to spread spam — including mass-messaging bakers or customers, posting duplicate listings, or injecting irrelevant keywords into titles and descriptions.
• Uploading images that are copyrighted, misleading, or unrelated to the listed product.
• Posting fake, incentivised, or malicious reviews.
• Harassing, threatening, or abusing other users of the platform.
• Attempting to move transactions off the platform to avoid accountability.

7Content ownership

You retain ownership of all content you upload to Kunch — product photos, listing descriptions, reviews, and profile images.

By uploading content, you grant Kunch a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely for the purpose of operating the platform. We will not use your images or content for advertising without your explicit permission.

Product images are stored on ImgBB's CDN and are publicly accessible via their URLs. Do not upload images containing personal information or images you do not own rights to.

8Reviews and ratings

• Only registered customers (not bakers) may post reviews.
• Each customer may post one review per product.
• Reviews must reflect genuine personal experience with the product.
• Kunch reserves the right to remove reviews that violate these terms — including fake, spam, abusive, or clearly irrelevant reviews — without notice.
• Bakers may report reviews they believe are fraudulent. We investigate all reports and take action when appropriate.
• Ratings displayed on product pages are averages of all valid customer ratings and are updated in real time.

9Spam detection and removal

Kunch actively monitors listings for spam and abusive content through automated detection and manual review. We take the following actions against spam:

• Listings with duplicate or near-duplicate titles from the same baker are automatically flagged for review.
• Listings with prices set to implausibly low amounts (e.g. Re 0.01) designed to game search rankings are removed.
• Listings or reviews containing repeated keywords, phone numbers in titles, or external URLs are flagged and reviewed.
• Bakers who repeatedly create and delete listings to game visibility rankings are suspended.
• Any account found to be operating a network of fake profiles or reviews is permanently banned.

You can report suspected spam listings using the report function on any product page. We review all reports within 48 hours.

10Account suspension and termination

Kunch reserves the right to suspend or permanently terminate any account that:

• Violates any provision of these Terms of Service.
• Receives a significant number of credible reports from other users.
• Is found to have provided false or misleading information during onboarding.
• Has been inactive for more than 24 months.

We will attempt to notify you before suspension unless the violation is severe enough to warrant immediate action (e.g. illegal content, fraud, or abuse). You may appeal a suspension by contacting us at support@Kunch.in.

11Disclaimer of warranties

Kunch makes no warranties regarding the accuracy, completeness, or quality of any listing, review, rating, baker profile, or other content on the platform. All such content is provided by users, and Kunch is not responsible for its accuracy.

12Limitation of liability

To the maximum extent permitted by applicable law, Kunch Technologies Pvt. Ltd., its directors, employees, and partners shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the platform.
• Any food safety incidents, allergic reactions, or health issues arising from products ordered via Kunch.
• Any loss arising from transactions between customers and bakers, including non-delivery, poor quality, or fraud.
• Any loss of data, profits, or goodwill arising from use or inability to use the platform.

Our total liability to you for any claim arising from the use of Kunch shall not exceed INR 500 (five hundred Indian Rupees).

13Governing law and disputes

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts in India.

We encourage users to resolve disputes informally by contacting us first. We aim to respond to all disputes within 10 business days.

14Changes to these terms

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of Kunch after an update constitutes acceptance of the revised terms. If you disagree with a change, you should stop using the platform and may request account deletion.
